Bringing an Employment-Related Lawsuit

In California, workers who have suffered unlawful conduct in violation of their rights under the Fair Employment and Housing Act must file a complaint with the Department of Fair Employment and Housing (DFEH). You must file a claim before you can file a lawsuit.
You have a limited period of time in which to bring a claim of discrimination or harassment in the workplace (statute of limitations). Generally this must be done within one year of the conduct (there are limited exceptions).

The DFEH can investigate your claim and bring suit on your behalf, or you can file for an immediate Right to Sue. Do not do so until you have spoken with an attorney.
